Legal Eligibility (Nebraska Revised Statute 29-2264)
You may petition the sentencing court to “set aside” your Nebraska criminal conviction if you were sentenced to:
• probation that was satisfactorily completed;
• fines that have been paid in full;
• community service that has been completed; or
• incarceration for a term of one-year or less.
If you have unpaid fines or were unsatisfactorily discharged from probation, you will not be eligible for a set aside.
A set aside is a court order which “nullifies” or voids the conviction but does not remove the conviction from your criminal record. When a criminal conviction is set aside, your criminal background check will show both the original conviction and the set aside order. The set aside of the conviction shows that the judge believed you have been rehabilitated and will remain law-abiding in the future.
The decision is completely up to the judge whether to grant the set aside.

Clinic Eligibility
This application covers personal information, demographics, case information, and financial information to determine if you are eligible for the clinic. The form may take between 20-30 minutes to complete.
You must income and asset qualify for Legal Aid of Nebraska services. Additionally, to participate in this clinic, the following must be true:
• You do not have any pending charges;
• You have no new criminal or traffic offenses since May 2024; and
• It has been at least one year since you completed the sentence for your most recent conviction.
Please note that appointments are limited and registration is based on a first come, first served basis. Failure to attend your scheduled clinic appointment may limit your ability to attend future Legal Aid of Nebraska clinics.
Residency in Douglas or Sarpy County is not required for the clinic, but we will only complete Douglas and Sarpy County cases.
